[Work] About Short Term Work Permit for Foreigners or Invitation Letter for Foreign Experts to China

Conditions for Application

Foreigner's short-term job in China refers to entry because of the following reasons with a stay no more than 90 days:


(1) To complete certain technology, scientific research, management, or guidance work at a partner's place in China;

(2) Tryout at sports institutions in China (including coaches and athletes);

(3) To shoot films (including advertisements and documentaries);

(4) Fashion show (including car model, shooting for print ads, etc.);

(5) Commercial performance concerning foreign affairs.

Fill in the form online and print it for signing. After it is signed by the applicant (the form signed by the applicant is sent back via fax or mail) and stamped by the employer, upload it to the system.

The applicant must promise that he or she has a clean police record.

The document should include the applicant's name, nationality, workplace address, working duration, and job responsibilities.

Clarifications are needed if the applicant has multiple workplace addresses or multiple entries into China.

The employer should clarify the budget for inviting the applicant, promise the authenticity of the employment, and guarantee that the expenses incurred during the applicant's stay in China will be paid.

Supporting materials of the applicant's qualification for Category A foreign talents should be submitted while applying for a Foreign Expert Invitation Letter.

Notes:
(1) Applicants accredited as high-end foreign talents (Category A) are eligible to apply for a Foreign Expert Invitation Letter. The accompanying personnel of the applicant should also submit their personal information and supporting materials.

(2) Applicants of short-term Foreigner's Work Permit (90 days or less) are allowed to work for multiple employers. All the workplace addresses should be listed in the application.

(3) Applicants should obey the approved duration of stay. Overstaying is not allowed.

(4) Holders of Z Visa (work visa) who may stay in China for less than 30 days do not need to apply for a working residence permit. If the duration of stay is 30 days or more, the holders should apply for a working residence permit in place of the work visa.

(5) Holders of Foreign Expert Invitation Letter can apply for F Visa and are not required to apply for a working residence permit after entering the Chinese mainland.

(6) If the applicant is engaged in an occupation that requires pre-approval from an industry authority or a professional qualification certificate, a letter of approval issued by the industry authority or a professional qualification certificate should be provided.

(7) According to the work requirements, permit acceptance or decision-making agencies are eligible to verify the authenticity of application materials by conducting interviews, telephone inquiries and on-site investigations as well as adopting other measures.

(8) Except for passport or international travel documents, all materials that are not in Chinese should have a translated version stamped by the employer provided (materials that are not in English should be translated by a professional translation agency).

(9) All materials and their Chinese translations should be scanned and uploaded to the online application system.

Handling Procedures

1. Submit online. The employers or the intermediates shall submit the application information online.

2. Preliminarily review and accept online. The competent department shall make a preliminary review and acceptation on the documents that have already uploaded by the employers online within five working days as the date of submitting (excluding this date). The department shall make a comprehensive notice to the employers if their documents are not qualified and accept the one that is qualified and issue the acceptation notice online.

3. Review. The competent departments shall review and make a decision within 5 working days without submitting paper documents for verification.

4. Decision making. The competent department shall approve the qualified and capable applicants to get the work permit less than 90 days and issue the notification letter online without checking the paper documents. The department shall also reject the unsuitable applicants with a decent reason and notice the applicants or the employers have the right to apply it again or apply for a suit. The applicant that is qualified to get the invitation letter shall collect it at the issuing authority without submitting paper documents for verification. 

If the application for the Foreigner's Work Permit in China (to work in China for more than 90 days) is filed in China and is approved, the Foreigner’s Work Permit will be directly issued. Before the valid visa or residence permit expires, the work-type residence permit shall be processed at the exit-entry administrative body of the local public security organ in the jurisdiction where the employer is located.
