Hunan Adjusts 45 Administrative Power Matters

On October 25, the Hunan government issued the circular on adjusting some administrative power matters. A total of 45 administrative power matters were adjusted, including 11 matters added, 10 matters cancelled, and 24 matters’ powers delegated.  

The powers of 24 matters were delegated to primary-level governments in accordance with the principle of “ensuring all eligible matters delegated, facilitating supervision, and strengthening services”. The move was an extension of related powers delegated by the provincial government last year. Powers of matters regarding environmental protection and radiation management, river management, shipping, and storage of hazardous chemicals were delegated through a whole-process and situation-based mothed. This would help improve the efficiency of administrative approvals, and facilitate supervision of local authorities. Matters regarding fireworks and firecrackers production, TV program production, and pawn shops establishment followed the principle of “delegating powers to lower levels instead of responsibilities”. Powers of these matters would be delegated by entrustment, which would be approved by lower governments and supervised by provincial and its lower governments together.

The 11 new administrative power matters focus on food safety and other areas that have attracted public attention in recent years. Nine of them were related to food and grain security. The adjustment was made based on newly established or revised laws and related regulations since last year, including "Regulations on Railway Safety Management of Hunan Province", "The Food Safety Law of the People's Republic of China", and "Regulations on Grain Circulation Management".

The 10 canceled matters were an implementation of the reform for separating operating permits from business licenses put forward by the State Council, and helped unleash market vitality. Matters regarding sci-tech basic condition platforms, filing of class hour-based fee standards in driving schools, and filing of sports business venues were cancelled. Follow-up ongoing and ex post oversight measures were defined. 

The Hunan Provincial People’s Government, according to the reform of “one-step approval process”, has adjusted 1,106 administrative power matters of the provincial government departments, and delegated 33 municipal-level economic and social management power matters to counties or county-level cities since 2019, in a bid to support development and governance of primary-level governments.
