Qualification for Overseas Organizations Introducing Foreign Cultural and Educational Experts to Work in Hunan

Permission item: Qualification for overseas organizations introducing foreign cultural and educational experts to work in Hunan  

  

Action object: overseas organizations that have an administrative body in Hunan and plan to dispatch cultural and educational experts to Hunan. 

 

Permission basis: The Decision of the State Council on Establishing Administrative Licenseing for the Administrative Examination and Approval, Items Actually Necessary to Be Preservedrequired for approval (No. 412 [2004] of the State Council)

 

Fee: free of charge 

Fee basis: no 

Time limit: Within 45 working days 

  

Requirements:  

Permission conditions: Overseas organizations must meet the following conditions to apply for the Qualification for overseas organizations introducing foreign cultural and educational experts to work in Hunan 

  

Procedures:  

 

Permission procedures:  

 

I. Acceptance  

 

1. Person-in-charge: personnel in the Office of Foreign Experts Affairs (acceptance telephone: 0731--82215730, websitewww.hnrst.gov.cn) 

 

2. Responsibilities and authorities 

According to the statutory permission conditions and standards, it is demanded to checkis mandatory to check if the materials are complete and in accordance with the statutory forms, if the application item is within the responsibilities and authorities of administrative bodies, if the approval application is submitted in the due time required according to rules and regulations and if the applicant is qualified to apply, and then the decision on acceptance or not rejection is to be made. Meanwhile, all the issues are dealt with according to provisions of Article 32 of the Administrative Permission Law.

 

(1) Applicants should be told in time that the application item is not to be accepted if it needs no administrative permission;  

 

(2) If application items are not within the responsibilities and authorities of the administrative body, decisions should be made in time not to accept them and the applicants should be told to apply to related administrative authorities; 

 

(3) If there are mistakes in the application materials that can be corrected on the spot, applicants should be allowed to correct them; 

 

(4) If the application materials are incomplete or don't conform to the statutory form, the authority shall, on the spot or within 5 days, inform the applicant of the items to be supplemented or corrected. If the applicant is not informed within the required time, the application materials are regarded as accepted. 

 

(5) If the application item falls within the responsibilities and authorities of the administrative body, and materials are complete and in accordance with the statutory forms, or the applicant has submitted all corrected application materials according to the requirements by the administrative authority, the application should be accepted for administrative approval. 

 

(6) To accept or not to accept the application for administrative approval, the administrative authority shall issue a written document with a designated seal and the date indicated.  

 

3. Time limit: Immediate

 

II. Examination and Check  

 

1. Person-in-charge: personnel in the Office of Foreign Experts Affairs 

 

2. Responsibilities and authorities:  

 

(1) In accordance with the permission conditions, materials submitted by the applicant are to be examined in terms of legality and authenticity. If there are materials that needed requireto be supplementsed and correctionted, the person-in-charge of permission projects shall once and for allthoroughly inform the applicant of all the details needed to be supplemented and corrected.

 

(2) After the preliminary examination opinions are givenprovided, those the materials that meet the conditions are required to be signed opinions in the public security and foreign affairs departments, before submitted submission, to the official-in-charge for examination and approval.

 

(3) Time limit: Within 35 working days 

  

III. Decision  

 

1. Person-in-charge: personnel in charge of the Office of Foreign Experts Affairs  

 

2. Responsibilities and authorities:  

 

(1) The submitted materials shall be given a final examination 

 

(2) With respect to approval of the preliminary examination, opinions shall be signed on the application form for qualification for overseas organizations introducing foreign cultural and educational experts to work in China and permission formalities shall be gone through.  

 

(3) With respect to disapproval of the preliminary examination, rejection opinions shall be given to the person responsible for projects, and reasons shall be provided in the written form. 

 

3. Time limit: Within 10 working days  

  

IV. Notification and certification  

 

1. Person-in-charge: personnel for preliminary examination in the Office of Foreign Experts Affairs  

 

2. Responsibilities and authorities:   

 

(1) Timely and correctly inform the applicant to get the certificates 

 

(2) As for the disapproved applications, reasons, relevant rights and complaint channels shall be told informed to the applicant once and for allthoroughly. Also, the disapproved materials shall be returned to the applicant.

 

(3) Written materials shall be put into archives in line with requirements
