Legal Time limit

 

Legal time limit for the alternation of Chinese-foreign cooperatively-run schools offering education for non-academic qualifications is 3 months.

 

 

Commitment Time Limit

Commitment time limit for the alternation of Chinese-foreign cooperatively run schools offering education for non-academic qualifications is within 45 working days.

 

 

 

Qualifications

Alteration of cooperators running a Chinese-foreign cooperatively-run school shall be proposed by the cooperators;

Financial liquidation shall be made and approved by the board of trustees, the board of directors or the joint managerial committee;

The new cooperators shall meet legal requirements.

 

 

Procedures

I. Acceptance

1.Person in charge: official working for International Exchange Office (Office of Hong Kong Macao and Taiwan Affairs) of the Education Department of Hunan Province

2.Responsibilities and authorities: qualification of applicants if the matters falling under the administrative organ and related application materials are complete and in consistency with the statutory form, and also if the application for administrative license is made within the time limit prescribed in laws and regulations ; to decide to accept the case or not and to handle the application in accordance with the provisions of article 32 in Administrative License Law:

 

(1)if the matter are not subject to administrative license in accordance with the law, applicant shall be informed immediately;;

 

(2) If the matter does not fall within the functions of the administrative organ, applicant shall be informed to file an application for it with the relevant administrative organ;

 

(3) Permitting the on-the-spot correction of application materials if there are any mistakes in the application materials;

 

(4)Informing the applicant on the spot or within 5 working days about the corrections required in the materials in case they are not complete or do not tally with statutory form; if it fails to do so within the time limit, the day when the application materials are accepted shall be considered as the acceptance day.

 

(5)Accepting the application of administrative permission if the application items are within the authority of the position and the application materials are complete, or the applicant submits the application materials in line with the requirements.

 

Where the matter applied for falls within the functions of the administrative organ and application materials are complete and in consistency with the statutory form, or the applicant has supplemented and corrected all the required items , the application for administrative license shall be accepted.

 

(6) Written confirmation shall be made in case of acceptance and rejection of the administrative application.

When accepting or rejecting an application for administrative license, the administrative organ shall issue a written proof.

 

 

3.Time limit: within 2 working days

 

 

 

 

Ⅱ. Censoring

(Ⅰ) Preliminary examination

1.Person in charge: officials of International Exchange Office (Office of Hong Kong, Macao and Taiwan Affairs) of the Education Department of Hunan Province

 

 

2. Responsibilities and authorities:

(1) Examining the legality and authenticity of the materials submitted by the applicant according to permissive conditions;

(2) Submitting opinions of preliminary examination to the person in charge of the department for reexamination.

(3) Informing the applicant within 15 working days of all contents that need correction if the application materials are not complete.

 

3. Time limit: within 15 working days

 

 

 

 

(Ⅱ) Reexamination

1.Person in charge: director of International Exchange Office (Office of Hong Kong, Macao and Taiwan Affairs) of the Education Department of Hunan Province

2. Responsibilities and authorities:

(1) Reexamining the legality and authenticity of the application materials according to permissive conditions and standards;

(2) For the qualified cases, putting forward verifying opinions in written form and submitting it to the Director-General of the Education Department of Hunan Province for decision; for the unqualified cases, putting forward dissenting opinions and reasons in writing and returning them and the application materials to the preliminary examination staff.

3. Time limit: within 20 working days

 

 

 

Ⅲ. Decision

1.Person in charge: chief of the Subdivision of the Education Department of Hunan Province

2.Responsibilities and authorities:

(1) Examining and approving the application materials and verifying opinions of experts in accordance with permissive conditions and related standards;

(2) For the qualified cases, writing remarks of approval on the approval sheet and reporting to Ministry of Education for approval and filling; for the unqualified cases, disapproving the administrative license and returning the application materials to the International Exchange Office (Office of Hong Kong Macao and Taiwan Affairs).

(3) Time limit: within 5 working days

 

 

Ⅳ. Public notification

1.Person in charge: official of International Exchange Office (Office of Hong Kong, Macao and Taiwan Affairs) of the Education Department of Hunan Province

 

2. Responsibilities and authorities:

(1) Publicly notifying the verifying results and promptly and accurately informing the applicant of the result if there is no objection;

(2) Making and delivering the decision of not granting administrative license, providing reasons, returning them and the application materials to the applicant, and informing the applicant of the legal right to apply for administrative reconsideration or bring an administrative lawsuit in accordance with law.

(3) Filing away the textual materials as required.

 

3.Time limit: within 3 working days
