Qualifications 

The approval of such projects should:   

(1) be qualified for the conditions as prescribed in relevant laws of the People’s Republic of China, the Catalogue for the  Guidance of Foreign Investment Industries, and the  Catalogue of Advantaged Industries for Foreign Investment in the Central-Western Region;  

(2) comply with the medium and long-term development  schemes for national economic and social development, and the policies for industrial planning and restructuring;  

(3) be consistent with public interest and relevant provisions  on anti-monopoly;    

(4) be pursuant to land utilization planning, overall city plan  and be in accordance with requirements for environment  protection;  

 (5) meet technical and process standards specified by state  regulations;   

(6) be in line with state regulations on the management of  capital projects and overseas loans

Procedures 

. Acceptance  

() Person in charge: acceptance staff of Foreign  Economic Cooperation Office of the department  

() Responsibilities and authorities:   

To check whether the application materials are complete,  whether the application items are within the authority of the  position, and whether the applicant is qualified; to decide  

whether to accept the case or not and make dispositions  respectively in accordance with Article 32 of  Administrative Permission Law:  

(1) Making the rejection decision and informing applicant of   application’s status if the application items are outside of the  authority of the position  

(2)Permitting on-the-spot correction of application materials, if any;  

(3)Informing the applicant on the spot of all the contents that  need correction if the application materials are not complete  or do not tally with statutory form; receiving the application  materials without timely inform of correction or supplement  shall be regarded as acceptance of the case; 

(4)Accepting the application of administrative permission if the application and the corresponding materials are complete, or  the applicant submits the application materials in line with the  requirements.  

(5)Filling in the notification of acceptance.

() Preliminary verification  

1.Person in charge: acceptance staff of Foreign Economic  Cooperation Office of the department 

(II) Responsibilities and authorities:  

(1) Examining the legality and authenticity of the materials  submitted by the applicant according to permissive conditions and standards.   

(2) Informing the applicant of the reasons for rejection and  extending opinions; submitting  

opinions of preliminary verification to the person in charge of  the department for reexamination.

(III)Reexamination  

1.Person in charge: Director of the branch office of Foreign  Economic Cooperation Office of the department  

2.Responsibilities and authorities:  

(1) Reexamining the application materials and preliminary  verification opinions according to related terms and  standards;  

(2) Examining the authenticity of the materials according to  related standards, checking the preliminary verification  opinions; for the qualified cases, putting forward verifying  opinions in written form and submitting it to the deputy director of the branch office of Foreign Economic Cooperation Office  for decision; for the unqualified cases, putting forward  dissenting opinions and reasons in written form and returning  them and the application materials to the preliminary  

verification staff.  

3.Service deadline: within 4 working days

() Person in charge: director in charge of the Foreign Economic Cooperation Office of the department 

() Responsibilities and authorities:  

 1. Examining and approving the application materials and  

verifying opinions of experts in accordance with related  

standards;  

 2. For the qualified cases, writing remarks of approval; for the unqualified cases, writing dissenting opinions and reasons.  

 () Service deadline: within 4 working days  

 

 . Delivery and public notification:  

() Person in charge: staff of Foreign Economic  Cooperation Office of the department  

() Responsibilities and authorities:  

(1) Publicly notifying the verifying results and promptly and  accurately informing the applicant of the result if there is no  objection;  

(2) For the approved cases where approval documents are issued by Foreign Economic  

Cooperation Office, send the documents to the local  Development and Reform Development and send copy to the relevant provincial department.  

(3) For the cases not approved, making and delivering the  decision of not granting administrative license, giving reasons,  

returning them and the application materials to the applicant, and informing the applicant of the legal right to apply for  administrative reconsideration or bring an administrative  lawsuit in accordance with law.  

(4). Filing away the textual materials as required.
