Department of Human Resources and Social Security of Hunan Province will take the responsibilities of Hunan Administration of Foreign Experts Affairs, and is permitted to use its plate.

 

Main Responsibilities:
1.To undertake the governmental affairs of department leaders; to undertake the survey and coordination of comprehensive policies; to be responsible for organs' comprehensive coordination and governmental affairs' operation, and formulate working regulations and plans, to take charge of their supervision and inspection; to be responsible for handling the work assigned by leaders and conference decisions; to be responsible for organizing conferences, examining and verifying documents, handling messages, managing confidential files, secretarial affairs, settling proposals, receptions and contacts; to be responsible for publicizing government news, collecting and compiling governmental information relating to labor and social security; to be responsible for administrative logistics and safeguards.

 

2.To formulate and declare the legislative plans for labor and social insurance in this Province, to draw up, submit, revise and sort out local laws and regulations on labor and social insurance and drafts of administrative regulations, and to check regulatory documents released by the department; to supervise and inspect the implementation of the laws, rules and regulations on labor and social security in the employing units, and organize the investigate and punishment in cases violating these laws, rules and regulations; to direct and supervise the work of supervisory institutes in this Province; to be responsible for the supervision of labor security in the employing units directly under the administration of the Province, and be responsible for filing and inspection of the relevant labor and security rules and regulations; to supervise the administrative implementation of laws by administrative departments of labor and social security and authorized institutes in this Province; to undertake legal affairs for this department and take charge of administrative reconsideration and administrative response to charges for labor and social security; to be responsible for law popularization and consultation of the relevant laws, rules and regulations on labor and social insurance, and manage the service and consultation institutes of labor and social insurance policy and their qualification validation in this Province; to be responsible for the work of training, assessment and certification of the administrative officials of labor and social security.

 

3.To draft the Province's development plans for labor and social security; to organize and coordinate the construction of information networks for labor and social insurance; to undertake the work of statistics and information of provincial labor and social insurance, and release statistical reports, information materials and developmental budgets; to be responsible for standardization in the Province's social insurance fields, research of science and technology, and promotion, application, publicity of achievements; to manage the undertaking funds of labor and social insurance at the provincial level, the international aid and loan programmes; to formulate the enforcement regulations for the management of the special funds such as the provincial social insurance funds and employment, and organize their implementation; to examine and verify the budget and final accounts of the provincial social insurance funds; to comprehensively collect special funds declarations, distribution and check on provincial labor and social security; to be responsible for the management of the department's financial affairs and state-owned assets operated under this department.

 

4.To formulate basic policies and measures of urban and rural laborer's employment; to plan and instruct the development of the labor market, and organize the establishment and management of the employment service system; to formulate policies to help state-owned enterprises in this Province out of difficult situations and supply subsistence allowances and re-employment opportunities for laid-off employees, and organize the implementation of the re-employment programme; to formulate distributive plans for the central government subsidies for subsistence allowances and subsistence allowances for laid-off employees in the provincial state-owned enterprises; to formulate plans for the employment service policies and policies for promoting the development of employment service enterprises; to draft management plans for employment agencies; to formulate policies and measures for provincial and regional labor flow, and for the development , employment and trans-regional orderly flow of surplus rural labor, and supervise their implementation; to administer the working cards of migrant workers and the employment permits of migrant laborers; to be responsible for, according to the division of labor, the administration of this Province's citizens who are working in foreign countries and foreigners who come to work in this Province; to be responsible for the centralized management of political arrangements and allocations; to formulate the employment policies and measures of helping rural residents become urban residents according to division of labor; to examine and verify advisements for recruitment; to formulate basic policies, reform programmes and development plans for provincial unemployment insurance and supervise their implementation; to formulate policies for unemployment insurance funds collection, special treatment projects and payment standards; to formulate methods of managing unemployment insurance funds, auditing plans of unemployment insurance funds, and supervise their implementation; to formulate vocational training for the unemployed, subsidy standards for vocational introduction, and treatment policies and administrative approaches relating to unemployed persons' diseases, pregnancy and death, to be responsible for examination and verification of the reform programmes of the unemployment insurance system in enterprises directly under the administration of the Province, and organize their implementation; to instruct, supervise and inspect the operation of organizations charged with the task of handling unemployment insurance in this Province.

 

5.To implement vocational classification, national standards of vocational skills and relevant vocational standards, and formulate specific measures for vocational skill training, evaluation and competition in this Province, and organize their implementation; to formulate measures for the implementation of vocational training systems, and instruct the work of the vocational training agencies such as training schools and those focusing on vocational skills, and directing the work of students recruitment and graduate employment for skilled workers training schools in this Province; to draft plans and measures for managing the teachers' team and teaching materials for these skilled workers training schools and vocational skill training agencies; to promote a system of vocational qualification certificates, and formulate measures for the implementation of vocational skill evaluation, and direct and supervise the vocational skill evaluation agencies, and issue vocational qualification certificates; to comprehensively administer the work of evaluation for workers in this Province; to formulate the plans and policies of vocational skill training for enterprises' workers, the unemployed, laid-off workers from state-owned enterprises and surplus rural labor; to evaluate "Technique Master of Hunan Province".

 

6.To formulate the basic regulations for the adjustment of the labor relationship, and take charge of management of the labor contracts, and undertake the management and verification of labor contracts of the central government-owned, province-owned units and foreign-invested enterprises in Changsha, and the management of the evaluation and verification of the collective contracts; to formulate policies on handling the labor relationship of state-owned enterprises' laid-off workers and economic employee reduction; to supervise the implementation of policies of workers' working hours, rest and holiday systems, family leave systems, workers' welfare systems and labor protection for female workers, underage employees and special jobs; to direct the management of labor in this Province; to direct the social intermediary agencies to formulate the local labor force quota system, and evaluate and release the relevant policies; to draw up basic standards for the punishment of enterprises' workers in this province; to participate in the evaluation of national and provincial working models; to draw up macro-control policies for enterprises salary and reform programmes of the enterprises allocation system, and organize their implementation; to formulate the enterprises salary guidelines, the Province's minimum salary standards and supervise their implementation; to comprehensively coordinate policies of salary systems in foreign-invested enterprises in this Province; to formulate the policies and measures of income allocation for the managers of state-owned enterprises, and evaluate gross salaries of province-owned enterprises and salary standards of the enterprises' main managers; to supervise and inspect, with relevant agencies, the inside and outside income of the enterprises' salaries.

 

7.To formulate labor dispute arbitration regulations for this Province, and direct the work of handling the Province's labor disputes and collective contract disputes; to be responsible for building up arbitration personnel for this Province's labor disputes, and train full- and part-time labor dispute arbitrators and enterprise labor dispute regulators; to be responsible for the qualification evaluation and certification of full- and part-time labor dispute arbitrators in this Province; to be responsible for labor dispute cases of the central government-owned, province-owned and foreign-funded enterprises; to take charge of and instruct the work of handling letters and visits of the Province's labor security administration agencies; to undertake the department's work of handling letters and visits and the office daily work of the labor dispute arbitration committee of Hunan province.

 

8.To formulate the basic policies, reform programmes and development plans of this Province's endowment insurance, and organize their implementation; to draw up policies of basic endowment insurance funds collection, social plans and individual account management; to formulate the treatment programmes, apply conditions, payment standards of basic endowment insurances, adjustment policies of basic endowment insurance funds and development plans for the management socialization of endowment insurances; to formulate policies of counting the fixed number of years for retirement, seniority and payment of endowment insurance for employees in enterprises of cities and towns, and formulate policies for the migration payment for dead employees in cities and towns and treatment policies and standards for employees suffering injury or disability while not employed; to formulate and improve regulations and policies of endowment insurances, and organize and supervise their implementation; to formulate an approval system and measures for enterprise workers' retirement; to be responsible for identification and management of early retirement from special jobs in the Province, and handle the work of identification of early retirement in accordance with relevant national policies; to participate in drafting regulations and policies of retired employees in national institutes and enterprises; to be responsible for the examination and approval of employee's retirement in enterprises directly administered by the Province; to be responsible for basic endowment pension adjustments for members in basic endowment insurance collection institutes administered by the province directly; to instruct, supervise and inspect the operation of organizations charged with the task of handling endowment insurance throughout the Province.

 

9.To formulate the reform programmes, development plans and basic policies in terms of medical treatment, industrial injury and maternity insurance systems, and organize their implementation; to formulate policies, treatment programmess and standards for collecting medical, industrial injury and maternity insurance funds; to formulate policies and measures for social planning for medical, industrial injury and maternity insurance funds, individual accounts of medical insurance and enterprise supplementary medical insurance, civil servants medical subsidy costs, serious disease medical aids and medical guarantees for special groups; to formulate administrative measures for designated medical organizations, designated pharmacies and designated medical organizations for labor ability identification; to be responsible for qualification identification and annual examination of the designated medical organizations of medical insurance directly operated by the Province; to organize relevant agencies to formulate drug directories, clinical programmes, standards and prices for medical service facilities of basic medical insurance, and to formulate standards and measures of medical treatment periods for injuries and diseases, work ability, vocational rehabilitation identification, and draw up management regulations for labor ability identification organizations; to undertake the work of the office of the employee committee; to instruct, supervise and inspect the operation of the organizations charged with the task of handling medical insurance throughout the Province.

 

10.To study and formulate the plans and policies for socialized and normalized management and services of rural endowment insurance, and organize their implementation; to formulate fund-raising policies, payment conditions, payment standards from rural endowment insurance funds and transferring methods of the endowment insurance; to draw up regulations for the rural endowment insurance funds management; to direct, supervise and inspect the operation of rural endowment insurance agencies in this Province.

 

11.To comprehensively coordinate the management of different kinds of social insurance funds; to formulate a supervision system for social insurance funds and the management regulations of organizations charged with the task of handling social insurance funds, and supervise the implementation of the different social insurance funds; to be responsible for the internal audit of social insurance and the qualification identification of the internal auditor, and administer supervision and an offence-reporting system for social insurance funds, accept complaints and reports, and punish major violations of fund management; to evaluate the qualification of the investment agencies to operate social insurance funds, and supervise the implementation of operations within a fixed period; to examine and verify allocation programmes for regulating funds at provincial level for different social insurances; to examine and verify the qualification of relevant organizations to undertake, supplementary endowment insurance, and supplementary medical insurance, and to supervise their implementation within a fixed period; to be responsible for financial audits and supervision of the institutions directly administrated by this department.

 

12.To be responsible for assessment, employment, dismissing, assignment, rewards and punishment of the cadres in this department and cadres administered by the department in institutions directly operated by this department; to be responsible for personnel file management and cadres statistics of the staff administered by the department; to be responsible for the set-up, staff size, salary and welfare, social insurance and family planning supervision in the department and institutions directly administrated by this department; to be responsible for the administration of professional technical qualifications; to formulate the education and training planning and plans for cadres in the labor and social security system, and organize their implementation; to be responsible for the education and training, immigration examination and approval of the staff of the department and institutions directly administrated by this department.
